Frequently asked questions

What should I do to receive compensation after a road accident?

First, a written claim is filed with the “Civil Liability” (motor third-party liability) insurer of the driver at fault (Art. 380 of the Insurance Code). The insurer must give a final answer within three months of the claim (Art. 496(1) of the Insurance Code). If it does not pay within this period, refuses, or offers an amount you do not agree with, you can file a claim in court (Art. 498(3) of the Insurance Code). Rosen Dimitrov, Attorney-at-Law, handles such cases in Sofia, Plovdiv and throughout the country.

What is the deadline to file a medical malpractice case?

The general limitation period is five years (Art. 110 of the Obligations and Contracts Act). For a tort, it starts to run from the discovery of the person who caused the damage (Art. 114(3) of the Obligations and Contracts Act). Do not delay – the medical records must be requested and preserved in time. At our office in Sofia, 66 Vitosha Blvd., we handle cases against hospitals and doctors.

If I win the case, who pays my lawyer?

If the claim is upheld, the defendant owes you the fees, costs and remuneration for one lawyer that you paid, in proportion to the part of the claim that was upheld (Art. 78(1) of the Civil Procedure Code). If the lawyer’s fee is excessive, at the request of the other party the court may award a lower amount (Art. 78(5) of the Civil Procedure Code).

How long does a civil case in Sofia take?

It depends on the type of case and the workload of the court. Cases in Sofia often take longer, so it is important for the case to be well prepared from the very beginning – with all evidence and requests in the statement of claim. When the court does not perform a procedural action in time, a party may file a complaint about delay (Art. 255(1) of the Civil Procedure Code). At the first meeting, we will tell you what time frame to expect.

Can I consult a lawyer in Sofia online?

Yes. The consultation can be by phone or video call, and documents are sent by email. If you prefer to meet in person, you are welcome at the office at 66 Vitosha Blvd., near NDK, by prior appointment.
